1The Hague Convention, which was signed into effect on October 18, 1907, in the Hague,
the Netherlands, ratified by defendant on November 6, 1911, and promulgated it on January
13, 1912, provides in Article 3 thereof, “A belligerent party which violates the provisions the
said Regulations shall, if the case demands, be liable to pay compensation. It shall be responsible
for all acts committed by persons forming part of its armed forces.”
In accordance with its language, Article 3 clearly places on the state the duty to compensate
for actions in violation of the Hague Regulations committed by persons forming part of its armed forces in the course their official duty.However,Article 3 does not distinctly enumerate the subject of the injury who is entitled to compensation, the opposing party in the compensation, nor the method of payment.
